What Broadwick said

On 15 August Adam Daniels wrote that Broadwick would be pleased to arrange for a sound reading to be taken ‘at your residence’ by Joynes Nash, subject to availability.

In a further email the same day he said the community management team would be happy to speak in person or by phone and that Broadwick would be ‘more than happy’ to arrange for the Joynes Nash noise consultant team to ‘come and take a reading from your property’.

Why it matters

The wording used on 15 August did not state that Broadwick had a settled policy restricting any residential investigation to external or adjacent areas only. The resident accepted the offer and supplied contact and access information. The proposed effective assessment at the affected residence did not occur.

This entry is relevant to Broadwick’s later assertion that its position was that readings could be taken only outside an affected property by arrangement.
